dc.description.abstract | In this Volume, the Majority of the Reported cases were decided
in 1993 in the High court of Kenya while others were decided in
the court of Appeal earlier on.
This Book devotes itself wholly to the interpretation given
by the courts to the various sections and orders of the Civil
Procedure Act and Rules Cap 21.
We have also included decisions on contempt of court as the
law relating to committal to civil jail for contempt of court
has been unclear and unstable due to it being related to the
existing laws of England. In these decisions, the High court
and the court of Appeal has given firm guidelines on how to
determine whether one is guilty of contempt of court in a civil
case.
We would also wish to ;note that although we may have
placed a case under one heading, many cases involve decisions
involving various other sections other than the one shown under
the heading or headnote and a cross reference is therefore
necessary. This is provided for by our index.
This Book is intended to be an update on the existing
decisions by our courts on the civil procedure Act and Rules. | en |
